Item # 2 from our delegation request letter...
We also will request additional clarification specifically regarding Logan Percy’s specific request from the October 5, 2023 council meeting, “Can you please explain to us what the real reason is for not entertaining the sale of road allowances where more than 66 feet exists?”. This question, in combination with the attached Crown Patent (item # 3 above) and reference plans (item #4 above) and with respect to Question # 12 from our original Q&A submission from August 17, 2023, provides a basis for our increase need for further clarification on this specific topic.
As a result of our research and in relation to the attached surveys indicating flooded original shore road allowances on both Halls Lake and Maple Lake, as well as numerous references to forced roads on Halls Lake Road, St. Peters Road, and North Shore Road, it is becoming clear to us that we have found a widespread and consistent theme of shore road allowance discrepancies, inaccuracies, corrections, township roads lying outside of their designated road allowances and road allowances that are far exceeding their prescribed width of 66 feet across the entire area being affected by this license policy.
We are now questioning whether any or all of the excess land beyond 66 feet from the original shore road allowance is actually township property, as all crown patents we have looked at (including the attached patent for Stanhope Lot 23/Con 5) are very specific in reserving exactly 1 chain (66 feet) of shore road allowance around all of the lakes in Stanhope.
Further to this, based on Ontario Land Surveyors official reference plans (some are attached) which show flooded shore road allowance on the two most affected lakes by this policy and many sections of the affected Municipal roads are identified as forced, we must now request that the Municipality provide further clarification and context for these discrepancies, as well as provide us with proof that the lands we are being asked to license from you are in fact owned fully by the township, including proof of the extents of these lands and that the original shore road allowance is in fact accurately identified around each of the affected lakes where the township is claiming ownership.
As of November 22, there has been no response from Algonquin Highlands to the HCLA question as to if they (AH) has title on the property in question.
